What Is an Apostille and When Do You Need One?
An apostille is an official authentication that allows a New York public document, such as a marriage certificate, to be used in another country that is a member of the Hague Apostille Convention. If you were married in New York City and need to present your marriage certificate to authorities abroad, you may be asked to obtain an apostille.
An apostilled NYC marriage certificate may be needed for many reasons, including:

For a New York City marriage record intended for foreign use, the NYC City Clerk issues an Extended Marriage Certificate. Before the New York State Department of State can issue the apostille, the NYC marriage record must also go through the required County Clerk authentication. Apostille vs. Certificate of Authentication: Which One Do You Need?
The document you need depends on the country where your marriage certificate will be used.
Apostille
If your document will be used in a country that participates in the Hague Apostille Convention, you will generally need an apostille. The apostille authenticates the New York public document so that it can be presented in another Hague Convention country without going through the traditional legalization process.
Certificate of Authentication
If the country where you need to use your marriage certificate is not part of the Hague Apostille Convention, the process is different. Instead of an apostille, the New York State Department of State issues a Certificate of Authentication. Depending on the destination country, additional authentication or legalization steps may also be required before the document can be used there.

Which NYC Marriage Certificate Do I Need for an Apostille?
If you were married in New York City and need to use your marriage certificate abroad, you will generally need an Extended Marriage Certificate for foreign use. The NYC City Clerk issues different versions of marriage records depending on how the document will be used. This distinction is important because the certificate you may already have at home is not necessarily the version you should request for international use.
Short Form vs. Extended Marriage Certificate
A short-form marriage certificate is generally used for domestic purposes within the United States. An Extended Marriage Certificate, also referred to by the NYC City Clerk as a marriage record for foreign use, contains additional information and is intended for situations where the marriage record will be presented to authorities outside the United States. If your goal is to obtain an apostille for use abroad, request the Extended Marriage Certificate for foreign use.
How Much Does the Extended Marriage Certificate Cost?
The current NYC City Clerk fees are:
- $35 for the first Extended Marriage Certificate
- $30 for each additional extended copy
For comparison, a domestic short-form marriage certificate costs $15 for the first copy and $10 for each additional copy.
What If I Already Have My Marriage Certificate?
If you already have a marriage certificate, don’t automatically assume that you need to order another one. First, check which version you have and where you intend to use it. If you are unsure whether your existing certificate is the appropriate version for the apostille process, I can help you identify what you have before you order another copy.
What If I Don’t Have My Marriage Certificate?
You can request an Extended Marriage Certificate directly from the NYC City Clerk. If you are no longer in New York or prefer not to handle the retrieval yourself, I can also retrieve the appropriate marriage certificate on your behalf with the required authorization and continue with the authentication and apostille process.
How to Apostille a NYC Marriage Certificate: The 3 Steps
Getting an apostille for a New York City marriage certificate involves three main steps.
Step 1: Get Your Extended Marriage Certificate
Request an Extended Marriage Certificate for foreign use from the NYC City Clerk. If you already have the correct Extended Marriage Certificate, you can move directly to the next step.
Step 2: Complete the County Clerk Authentication
Before your NYC marriage certificate can receive an apostille, it must be authenticated by the County Clerk. This step verifies the signature on the marriage record before the document is submitted to the New York State Department of State.
Step 3: Get the New York State Apostille
Once the County Clerk authentication is complete, your marriage certificate can be submitted to the New York State Department of State for the apostille. The current New York State apostille fee is $10 per document. Once these three steps are completed, your marriage certificate is ready to be presented to the foreign authority requesting the apostilled document.
How Much Does It Cost to Apostille a NYC Marriage Certificate?
If you complete the NYC marriage certificate apostille process yourself, there are government fees at each stage.
For one Extended Marriage Certificate, the current government fees are:
NYC City Clerk: $35 for the Extended Marriage Certificate
New York County Clerk: $3 for the authentication
New York State Department of State: $10 for the apostille
The total government cost for one Extended Marriage Certificate with authentication and apostille is $48. If you need additional copies, additional government fees will apply to each document. These are government fees only. They do not include shipping or the cost of hiring someone to retrieve your marriage certificate and complete the apostille process on your behalf.
How Long Does It Take to Get an Apostille for a NYC Marriage Certificate?
The processing time depends on whether you complete the process in person or by mail, and whether you already have the correct Extended Marriage Certificate.
If You Are in New York City
If you already have the correct Extended Marriage Certificate and your documents are properly prepared, the process can be completed relatively quickly in person. The New York State Department of State currently offers same day walk in apostille service at its New York City location for properly prepared documents. This means that once you have the correct marriage certificate and County Clerk authentication, the apostille itself can potentially be obtained the same day.
If You Are Applying by Mail
The process generally takes longer by mail because you need to allow time for processing and for documents to travel between you and the different offices. If you still need to obtain your Extended Marriage Certificate from the NYC City Clerk, you will also need to allow time for the marriage record request. Processing times can change, so if you need your apostilled marriage certificate for an upcoming visa appointment, residency application, move abroad, divorce proceeding or another deadline, it is best to begin the process as early as possible.
Can I Get a Same Day Apostille in NYC?
Yes. The New York State Department of State currently offers same day walk in apostille and authentication service at its New York City customer service counter when the documents are complete and properly prepared. However, obtaining the apostille is only the final part of the process. Your NYC marriage certificate must first be the appropriate certificate for foreign use and have the required County Clerk authentication. You can still obtain a copy of your NYC marriage certificate and have it apostilled even if your wedding took place many years ago. People often discover years after their wedding that they need an official marriage certificate for a new administrative or legal procedure. You may need it to register your marriage abroad, apply for residency, complete immigration paperwork, handle a divorce, change your name, or provide proof of marriage to another authority.

Here are some of the most common mistakes to avoid.
Requesting the Wrong Marriage Certificate
If your marriage certificate will be used abroad, make sure you request the appropriate Extended Marriage Certificate for foreign use. The standard marriage certificate you already have may not be the version you need for your international procedure.
Skipping the County Clerk Authentication
This is one of the most important steps in the process. A NYC marriage record must go through the required County Clerk authentication before it can be submitted to the New York State Department of State for an apostille.
Going directly to the Department of State without completing this step can result in your document being rejected.
Confusing an Apostille With a Certificate of Authentication
An apostille and a Certificate of Authentication are not the same thing. The correct process depends on the country where your marriage certificate will be used. Before starting, confirm whether your destination country participates in the Hague Apostille Convention.
Waiting Until the Last Minute
If you need your marriage certificate for a visa, residency application, divorce proceeding, marriage registration abroad or another deadline, give yourself enough time to complete the process. This is especially important if you need to request your marriage certificate first or if documents need to be mailed internationally.
Assuming You Have to Return to New York

Not Checking the Requirements of the Country Where the Document Will Be Used

Can I get my NYC marriage certificate apostilled if I live abroad?
Yes. You do not need to return to New York to complete the process.

Can I apostille a photocopy of my NYC marriage certificate?
Generally, you should not submit an ordinary photocopy of your marriage certificate for this process. The apostille process requires the appropriate official marriage record.

Do I need an apostille for France, the United Kingdom, Australia or Canada?
The requirements depend on the country where the document will be used and the purpose for which it is being requested.
France, the United Kingdom, Australia and Canada are parties to the Hague Apostille Convention, so an apostille may be required when a New York public document needs to be authenticated for use there.
However, always check the specific requirements of the authority receiving your document.
Does an apostille expire?
An apostille itself does not have a standard expiration date.
However, the authority receiving your marriage certificate may have its own rules about how recently the underlying document must have been issued. Before ordering a new marriage certificate or apostille, check the requirements of the authority requesting your document.
