Do I Need an Apostille or Authentication for My NYC Birth Certificate?

The first question to ask is:

Where will you use your birth certificate? If the destination country participates in the Hague Apostille Convention, you will generally need an Apostille. If the destination country does not participate in the Hague Apostille Convention, you may instead need a Certificate of Authentication, followed by additional authentication or consular steps depending on the country. You do not normally choose between an Apostille and Authentication yourself. The country and authority receiving your birth certificate determine which process is required.

What Is an Apostille for a NYC Birth Certificate?

An Apostille is a certificate issued by the New York State Department of State that authenticates a public document so that it can be presented in another country participating in the Hague Apostille Convention. For a NYC birth certificate, obtaining an Apostille can involve several steps. For foreign use, you may need to obtain the appropriate long-form NYC birth certificate with a Letter of Exemplification and complete the required New York certification steps before the document can receive an Apostille. What Is Authentication for a NYC Birth Certificate?

Authentication is generally used when a NYC birth certificate will be presented in a country where the Apostille Convention does not apply. The beginning of the process can look very similar to the Apostille process. You generally start with the appropriate NYC birth certificate and complete the required New York certification steps. Instead of receiving an Apostille at the end of the New York State process, however, the document receives a Certificate of Authentication. Depending on the destination country, additional authentication through federal authorities and/or the country’s embassy or consulate may also be required.

Apostille vs Authentication: What Is the Difference?

The main difference is the country where your NYC birth certificate will be used. An Apostille is generally used when the destination country participates in the Hague Apostille Convention. A Certificate of Authentication is generally used when the destination country is outside the Apostille Convention and requires the traditional authentication process. This is why it is important to know the destination country before starting the process.

Which Countries Require an Apostille for a NYC Birth Certificate?

If the destination country participates in the Hague Apostille Convention, a New York Apostille is generally the appropriate certification.

Which Countries May Require Authentication Instead?

If the destination country is not currently covered by the Hague Apostille Convention, an Apostille may not be the appropriate certification. Instead, your NYC birth certificate may need a Certificate of Authentication, followed by additional steps required by the destination country.

Important Changes for Thailand and Vietnam

Thailand: Thailand joined the Hague Apostille Convention in June 2026, but the Convention is not scheduled to enter into force for Thailand until February 28, 2027. Until then, documents for use in Thailand may still need to follow the authentication process.

Vietnam: Vietnam has also joined the Hague Apostille Convention. The Convention is scheduled to enter into force for Vietnam on September 11, 2026. Until that date, authentication requirements may still apply.

Because countries can join the Hague Apostille Convention and requirements can change, always confirm the current requirements before beginning the process. The requirements can also depend on the authority requesting the birth certificate and the purpose for which it will be used.

Why the Correct NYC Birth Certificate Matters

One of the most common problems is beginning the Apostille or Authentication process with the wrong version of a birth certificate. A standard or short-form certificate may not be appropriate for the required certification process. For many foreign-use requests, you may need to obtain a long-form NYC birth certificate with a Letter of Exemplification before proceeding with the required New York certification steps. This is particularly important if you are currently outside New York or outside the United States and do not want to discover later that you ordered the wrong document.

What Is a Letter of Exemplification?

A Letter of Exemplification is an additional document issued with certain NYC birth certificates. It provides an additional level of certification and may be needed when a NYC birth certificate is going through the authentication or Apostille process for international use. If you are ordering a new NYC birth certificate specifically because you need an Apostille or Authentication, it is important to determine which version of the certificate and supporting documentation you need before placing your order.
